STANDARD TERMS AND CONDITIONS FOR STUDIO RENTALS
(STANDARD TERMS AND CONDITIONS FOR STUDIO SESSIONS FOLLOWS)

The most important rules first:

* Please tell your clients that the bathrooms need to be kept clean - they'll be clean when you arrive and must be in the same condition when you are done. I will check this when I close up after you are done. Sorry to be so direct - there have been issues in the past.
* No smoking on the upstairs balcony and no smoking within 25 feet of the building.
* No vaping AT ALL within the studio.
* No loud music in the studio (medium level is fine).
* No music at all outside the studio or in the parking lot (even from cars with the windows down).
* No people can hang out in the parking lot or balcony while waiting - everyone must be in the studio.
* You MUST be wrapped-up and packed-up and walking out the studio at the end-time of your rental. Stay-overs are not permitted without prior authorization. Stay-overs will be billed in 30-minute increments.

USAGE TERMS: “Fourth Wall” is Fourth Wall Photo, LLC; “Premises” includes the studio, office, restroom facilities, kitchenette and parking areas leased by Fourth Wall Photo Studio, LLC.; “Renter” is the person or entity using Premises and/or equipment.

PAYMENTS:  Full payment is required before the reserved date. I will send a payment link once the booking is confirmed - payment is expected within 24 hours to keep the reservation.

CANCELLATIONS:  Any cancellation more than 48 hours out shall result in a full refund. Cancellations made 48 hours or less shall result in the forfeiture of the payment.

SECURITY CAMERAS:  Please be aware that there are security cameras in the studio that monitor and record 24/7. There is NO CAMERA COVERAGE in the changing room. These cannot be disabled for any reason.

LENGTH OF USE:  Usage periods are pre-arranged at the time of booking. Renter's Usage time begins promptly at the designated starting time and ends promptly at the designated ending time. There is no spill-over time - be sure to book enough time to load in and load out. The Studio must be cleaned and vacated by the end of the Usage period. No prior drop-off and/or pick-up after completion of shoot, of equipment, props, etc. unless negotiated at time of Usage agreement. Additional fees may apply. Early or extended hours must be worked out and paid for in advance before Usage period begins. unless otherwise agreed upon.

CLEANING & TRASH:  Renter agrees to leave the Premises and all contents and fixtures in the same condition as they were when Renter arrived. Fourth Wall will dispose of trash collected in the supplied trash cans. Renter must take all larger trash items with them when finished. There is no large trash item disposal at Fourth Wall. All items brought to the Premises by Renter are to be removed by Renter. Items left after 7 days will be assumed abandoned and may be discarded or kept by the Fourth Wall for Fourth Wall use, with no compensation due the Renter , at the discretion of the Fourth Wall. If Renter does not return Premises to the order and cleanliness found when Renter arrived, Fourth Wall will charge at minimum a $50 cleaning fee. This $50 cleaning fee will be applied if Renter leaves anything at all, other than trash in the trash receptacles, at the Studio. (but, please don't STUFF the trash cans! if there's that much trash, please take it with you!)

STUDIO RULES:

• No smoking whatsoever is allowed in the building or within 20 feet of any entrance.

• Food and drink are allowed – please be mindful and careful.

• No alcoholic beverages or non-prescription or illegal drugs.

• Music/voices are to be kept at reasonable levels and not contain vulgar or offensive lyrics or words.

• No one will be admitted who is drunk or under the influence of illegal substances.

• No pets allowed without prior consent of a Fourth Wall representative.

• Maximum of ten people in Renter's party. Ask ahead if you have a larger group.

• No pornography shall be photographed in the Studio. Boudoir photography is permitted. If shooting boudoir, Renter must pull the blinds on the window and door and lock the door to prevent non-participants from entering Fourth Wall.

• If you need the use of any equipment (lights, stands, backdrops ...) you MUST inform Fourth Wall at the time of booking. No equipment may be taken from the office/storage room without prior notice.

• The office/equipment storage room is off-limits and shall not be accessed or entered by Renter . This is why you MUST inform us if you need to use any equipment - you will not have access to it otherwise.

• Renter MUST arrive on time. A Fourth Wall representative will wait for 20 minutes after the booked start time for Renter. After we will leave and Renter forfeits their deposit and must still pay the full remainder due.

• Use of paint or any coloring substance is prohibited in the Studio.

WAIVER OF LIABILITY:  Use of Fourth Wall’s Premises and equipment is at Renter's risk. Renter hereby agrees that Fourth Wall will not be held liable for any direct, indirect, incidental, or consequential damage, injury or loss to Renter, his party or possessions while on the Premises or on the Property. Renter holds harmless and indemnifies Fourth Wall and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury or damages, including reasonable attorney’s fees. This indemnification shall continue in full force and effect during and after the term of the Usage for such causes arising during the term of the Usage.

CONDUCT:  Renter shall be solely responsible for the conduct and welfare of all persons accompanying Renter while on Fourth Wall’s Premises. Although very unlikely, Renter agrees that a Fourth Wall representative may, at Fourth Wall’s sole discretion, be present at all times. If the representative observes or otherwise becomes aware of dangerous, illegal, or negligent practices or activities, the representative reserves the right to stop the shoot and may require Renter and Renter's party to leave immediately. The authorities will be alerted to any illegal activities witnessed by the Fourth Wall representative. In such case no refund will be given for unused time. However, Fourth Wall and its representatives assume no responsibility to act in such cases.

AGE OF MODELS:  Renter is solely responsible for verifying that all photographic subjects are of legal age or accompanied by a parent or legal guardian. Fourth Wall has no responsibility to determine or verify the age of participants in the Renter's activities but reserves the right to demand proof of parental consent if models or photographic subjects are under the age of 18 and to end those activities if Fourth Wall becomes aware that legal age violations are occurring. Fourth Wall is not liable in the case of an invalid ID or any other form of age verification.

INSURANCE:  Businesses, Corporations, Production Companies and other legal entities may be required, prior to Usage, to present a certificate of general liability insurance naming Fourth Wall Photo Studio, LLC as additionally insured on the dates of the Usage. If so required, Renter's liability insurance shall be deemed primary and non-contributory insurance in the event of any claim or suit. Liability insurance shall be Commercial General Liability with a minimum of $1,000,000 per occurrence & annual aggregate.

EQUIPMENT:  If previously agreed upon, Fourth Wall shall provide equipment in good working order but makes no special guarantees as to said equipment’s functionality or suitability to Renter's purposes. No equipment is included in the Usage unless previously agreed upon. Renter shall notify Fourth Wall immediately of any malfunction, damage or other issues with the equipment. There is no studio phone service provided. Renter is advised to bring a cell phone. WiFi internet service is available during the Usage period. Code for access will be provided in the Usage agreement. Bathrooms are available next door with entry code 9125.

DAMAGE:  Renter shall be solely responsible for any damage to Fourth Wall’s property or equipment that occurs during the time Renter or his party occupies the Premises. Renter agrees to pay reasonable additional repair costs to bring damaged equipment back to working condition. Renter agrees to pay for damage to the Premises including spills, excessive wear, marks or stains on furniture, fixtures, or painted surfaces.

ADDITIONAL TIME, SERVICES, AND LATE PAYMENT:  All studio rentals must be prepaid in full prior to use. Any additional time requested by the renter beyond the original booking period will be billed at the prevailing hourly rate and is due immediately upon invoicing. Failure to remit payment within seven (7) days will result in a late fee equal to ten percent (10%) of the outstanding balance. An additional late fee of ten percent (10%) of the then-outstanding balance will be applied for each subsequent two-week (14-day) period that payment remains unpaid.

Unpaid balances may result in suspension or cancellation of future reservations, and the renter will remain responsible for all collection costs, including reasonable attorney’s fees, if applicable. Fourth Wall Photo Studio reserves the right to deny future bookings to any renter with a history of unpaid or delinquent charges.

ARBITRATION and MISCELLANY:  If the parties are unable to resolve any controversy or claim arising under this Agreement, other than actions to collect unpaid fees or charges due under this Agreement, they agree to submit the dispute or claim to binding arbitration subject to the commercial arbitration rules of the American Arbitration Association. Such arbitration shall take place in Maricopa County, Arizona, and shall be conducted before a single arbitrator selected from the Association’s panel of arbitrators. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to prevail in arbitration, fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including reasonable attorney’s fees, for having to compel arbitration or defend or enforce the award.

Notwithstanding the foregoing, Photographer may pursue actions to collect unpaid fees or charges due under this Agreement in the courts of Maricopa County, Arizona, and the parties consent to jurisdiction and venue therein. The prevailing party in any such action shall be entitled to recover reasonable attorney’s fees and costs.

Photographer shall comply in all respects with all federal, state, county, city, or other local laws, regulations, and ordinances, and with all rules and regulations of any governmental authority in connection with this Agreement. This Agreement incorporates the entire understanding and agreement between Fourth Wall and Photographer. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The laws of the State of Arizona shall govern this Agreement.

By submitting payment for your studio rental, you acknowledge that you have read, understood, and agreed to all of the above terms and conditions. This agreement is binding and enforceable upon payment.

STANDARD TERMS AND CONDITIONS FOR STUDIO SESSIONS

Please take a moment to review the following. These terms are in place to ensure we make the most of your time and get you the best results.

Scheduling & Arrival

I’m not at the studio all day — I arrive shortly before your scheduled session time, just like you. Please do not arrive late. If something comes up, text me at 602-743-1200. If you're more than 15 minutes late and haven’t contacted me, the session will be canceled without refund. I appreciate your understanding.

Payment, Confirmation & Refunds

Payment is required up front to reserve your session. Once you submit your booking request, I’ll follow up with a confirmation email and a payment link. Payment is expected within 24 hours of that confirmation email to hold your spot.

Rescheduling & Refunds

Life happens. If you need to reschedule, just let me know as soon as possible. There’s no refund for cancellations, but I’m flexible and happy to find a new time if you reach out in advance.

Clothing & Outfit Changes

A changing area is available in the studio.

You’re welcome to bring extra options — but only the number of looks you've paid for will be photographed at either the $25 package or the $50 package. You may bring extra changes if you want to -we'll just bill for them after. But please let me know if you do plan on doing that.

Editing & Delivery

Each outfit/look includes a minimum of six fully edited, high-resolution images. In the photographer-chooses $25 sessions, I select the final images based on the strongest shots from your session. If you’ve booked the "client-chooses" package, you’ll receive a proof gallery to choose your favorites before final editing begins.

All images include clean, natural retouching — skin, lighting, and color adjustments — to ensure a polished, professional look. Editing is done at the photographer’s discretion, and client-specific edit requests are not included.

Your final gallery will be delivered via private link within 48 hours of either your session (Photographer Chooses package) or your image selection (Client Chooses package).

Additional Edits

All edits are at the photographer's discretion - no client requested edit requests will be entertained.

Security Cameras

The studio is monitored by cameras 24/7, with the exception of the private changing area. These are in place for security and cannot be turned off or covered.

Image Usage

You receive full rights to use your images however you like — professionally, personally, online, in print, and beyond. You’ll receive high-resolution, unwatermarked files with no restrictions.

Images from your session may occasionally be used in my portfolio, on social media, or in marketing materials to showcase my work. If you prefer not to have your images shared, simply reply to your gallery delivery email or contact me directly, and I will gladly honor your request.

Late Payments and Remainder Owed on Services

Failure to remit payment for any amounts owed within seven (7) days will result in a late fee equal to ten percent (10%) of the outstanding balance. An additional late fee of ten percent (10%) of the then-outstanding balance will be applied for each subsequent two-week (14-day) period that payment remains unpaid.

Agreement

Payment of the session fee indicates agreement to the terms above.
